A diagnosis establishing the presence of asbestos is to realize for the sale any property of which the building permit was delivered before the 1st of July 1997 and to attach it to the sales agreement and to the proof of sale.
The search for asbestos concerns all the materials of the construction since May 3rd, 2002, and not only the flocking, insulation or false ceilings.
The diagnosis is to be made by a technical controller or a construction engineer approved by the Ministry of Health. This one must be able to supply a certificate of competence, delivered by a specialized body, and have subscribed to a professional insurance guaranteeing the civil liability, bound to the entrusted mission.
It is possible to inquire at the prefecture or on the Ministry of Health’s website to obtain a list of the persons authorized to supply this diagnosis.
The search for asbestos does not imply destructive works but only determine the presence of asbestos. If works turn out to be necessary, they will be at the seller’s expenditure.
If it demonstrates that the property does not contain asbestos, its validity is unlimited.
